IP Due Diligence
Conducted IP due diligence for a venture capitalist who was buying a company that claimed to have over 50 patents. Was able to determine that all of the patents boiled down to a very narrow set of claims that covered using a propane tank to power gardening tools. The venture capitalist was able to get the price lowered by over 60% due to our due diligence efforts, saving them millions of dollars.
IP Transaction Audits
Conducted IP due diligence on numerous asset sales and sales of businesses, for both the buyer and the seller (not on the same deal) to determine whether the Intellectual Property involved is titled in the name of the correct entity and, when necessary, fixed the title and ensured that the IP rights were current and enforceable (or, in at least one case, advised the prospective buyer to drop the deal, because the IP was essentially worthless).
Motorcycle Racer IP Dispute
Represent a nationally-famous motorcycle racer in a trademark and domain name dispute with his former business partner/brother.
Coffee Industry IP Case
Successfully prosecuted a trademark and copyright infringement case against a competitor in the coffee industry.
Medical Imaging Patent Defense
Successfully defended a value added reseller who was accused of infringing five patents on medical imaging software; won on eleven summary judgment motions; Non-Infringement and Invalidity Rulings were all Affirmed by the U.S. Court of Appeals for the Federal Circuit in one word: Affirmed.
Cloud Technology Patent Valuation
Obtained for the 'Father of the Cloud' a $15 Billion Valuation for his patents on technology architecture that allows users to share things, locations, objects, and people in virtual reality and augmented reality environments such that they can be shown and shared digitally, enabling interactions across geographical and temporal boundaries while improving the experiences of users of social media and online gaming.
