Printer Patent Indemnification Defense
Defended a Korean company in the printer and toner business whose customer was accused of patent infringement and suing our client for indemnification. We litigated the issues and enabled our client to collect all of the money owed to it and to avoid having to pay any money to the aggrieved customer.
Flame Retardant Patent Defense
Successfully defended a patent infringement case brought against our British client by a U.S. company over flame retardant materials; settled by purchasing the patent for less than the costs of procuring it.
Multi-Country Trademark License
Negotiated a multi-country license for trademark rights and franchises; termination clauses were so favorable to our client that when the licensee breached, it ended up purchasing our client-licensor.
T-Shirt Patent Defense
Successfully defended a company that makes t-shirts for Disney and Warner Brothers against a charge of patent infringement on a new technique for making silk-screen t- shirt appliques.
Copyright Troll Defense
Advised numerous clients on how to negotiate with Copyright Trolls to lower the amount of blood money that was being demanded for essentially innocent use of photographic images for which no license had been obtained in advance by the clients.
IP Due Diligence
Conducted IP due diligence for a venture capitalist who was buying a company that claimed to have over 50 patents. Was able to determine that all of the patents boiled down to a very narrow set of claims that covered using a propane tank to power gardening tools. The venture capitalist was able to get the price lowered by over 60% due to our due diligence efforts, saving them millions of dollars.
