Supplement Patent Defense
Successfully defended the manufacturer of a dietary supplement against charges of patent infringement brought by an extremely aggressive plaintiff; negotiated a settlement and a license agreement very favorable to our client.
IP Transaction Audits
Conducted IP due diligence on numerous asset sales and sales of businesses, for both the buyer and the seller (not on the same deal) to determine whether the Intellectual Property involved is titled in the name of the correct entity and, when necessary, fixed the title and ensured that the IP rights were current and enforceable (or, in at least one case, advised the prospective buyer to drop the deal, because the IP was essentially worthless).
Patent Infringement Defense
Represented several trading companies accused of infringing utility patents and design patents of a major New York fashion company; negotiated favorable license agreements in settlement.
Art Rights Negotiation
Negotiated the rights on behalf of an artist for a major public work of art, including the rights to manufacture gift shop items for sale in the gift shop of the large private organization that commissioned the work from the artist.
Healthcare IP Defense Settlement
Successfully defended a healthcare products manufacturer against claims of patent infringement and trademark infringement; settled the case by exchanging our client's domain name for money.
Cloud Technology Patent Valuation
Obtained for the 'Father of the Cloud' a $15 Billion Valuation for his patents on technology architecture that allows users to share things, locations, objects, and people in virtual reality and augmented reality environments such that they can be shown and shared digitally, enabling interactions across geographical and temporal boundaries while improving the experiences of users of social media and online gaming.
