Small Appliance Patent Guidance
Advised small appliances manufacturers on how to avoid patent infringement so they can sell more favorably priced products on Amazon without the fear of getting sued.
IP Transaction Audits
Conducted IP due diligence on numerous asset sales and sales of businesses, for both the buyer and the seller (not on the same deal) to determine whether the Intellectual Property involved is titled in the name of the correct entity and, when necessary, fixed the title and ensured that the IP rights were current and enforceable (or, in at least one case, advised the prospective buyer to drop the deal, because the IP was essentially worthless).
Multi-Country Trademark License
Negotiated a multi-country license for trademark rights and franchises; termination clauses were so favorable to our client that when the licensee breached, it ended up purchasing our client-licensor.
IP Due Diligence
Conducted IP due diligence for a venture capitalist who was buying a company that claimed to have over 50 patents. Was able to determine that all of the patents boiled down to a very narrow set of claims that covered using a propane tank to power gardening tools. The venture capitalist was able to get the price lowered by over 60% due to our due diligence efforts, saving them millions of dollars.
Coffee Industry IP Case
Successfully prosecuted a trademark and copyright infringement case against a competitor in the coffee industry.
Creative Trademark Registrations
Obtained numerous Registered Trademarks for clients on very clever terms, such as 'Death and Taxes' for a Probate Attorney; 'Strategical' for an Insurance Analyst; 'Shark With a Heart' for a Divorce Attorney; 'If You Don't Want To Retire, That is Your Business, If You Do Want To Retire That is Our Business' for a Wealth Manager; 'Our Business is Developing Yours' for a Branding and Marketing Expert; etc.
