Our goal is not simply to obtain patents, but to secure meaningful, enforceable protection that supports long-term business objectives, investment, and commercialization.
Patent registration is a powerful legal tool, but it is also complex and unforgiving. A misstep early in the process can permanently limit the scope or enforceability of your rights. The Patent Application & Prosecution Process
Patent registration, often referred to as “patent prosecution,” is a transactional process involving multiple stages of interaction with the U.S. Patent and Trademark Office (USPTO).
It includes:
- Drafting a detailed written description of the invention
- Preparing claims that define the legal scope of protection
- Filing the application with the appropriate patent office
- Responding to examiner questions and office actions
- Addressing prior art and legal objections
- Pursuing appeals when necessary
A critical part of this process is identifying and analyzing prior art, including earlier patents, publications, and public disclosures. Understanding what already exists allows us to strategically tailor patent claims, maximizing protection while minimizing the risk of rejection.
Our registered patent attorneys at HPL manage the entire prosecution process, from initial review through final issuance or appeal.
We offer complimentary initial consultations to help you understand whether patent protection makes sense for your invention. In many cases, we recommend starting with a prior art search and patentability analysis, which assesses the likelihood of obtaining a patent and identifies potential risks before incurring high costs.
This analysis allows us to advise you on whether to proceed, how to structure your claims, and which filing strategy best aligns with your business goals, often saving time and expense later in the process.
What Is Required to Obtain a Patent?
To qualify for patent protection in the U.S., an invention must meet three legal requirements:
- Novelty – the invention must be new
- Utility – it must serve a functional purpose
- Non-obviousness – it cannot be a noticeable variation of existing technology
In most cases, you must file a patent application within one year of publicly disclosing the invention, or you risk losing patent rights altogether.
